1. Uvodne odredbe

Molimo Vas pažljivo pročitajte odredbe dokumenta “Opšti uslovi korišćenja “Ski Prep” mobilne aplikacije” (u

daljem tekstu: Uslovi korišćenja). Uslovima korišćenja regulišu se međusobni odnosi između kompanije Aljoše

Ljubićić PR, kao vlasnika mobilne aplikacije „Ski Prep“ (u daljem tekstu: Vlasnik aplikacije) i Vas, kao korisnika iste.

Korisnik mobilne aplikacije „Ski Prep“ (u daljem tekstu: Aplikacija) je osoba koja ispunjava kriterijume predviđene

ovim Uslovima korišćenja Aplikacije i koja je pročitala, razumela i u potpunosti prihvatila Uslove korišćenja.

1.1. Uslovi će biti povremeno ažurirani ili menjani nakon čega će biti objavljivani na Aplikaciji.

1.2. Prilikom izmene ili revizije Uslova, da bi nastavio s korišćenjem Aplikacije, od Korisnika će biti zahtevana

saglasnost na izmenjene Uslove korišćenja i prihvatanje istih.

1.3. Ukoliko niste saglasni sa nekim od uslova navedenim u Uslovima korišćenja molimo Vas da ne koristite “Ski

Prep” Aplikaciju.

1.4. Aplikacija je vlasništvo kompanije Aljopa Ljubičić PR, ul. Vladimira Popovića 36, 11070 Novi Beograd PIB:

113541912, matični broj: 66898610.

1.5. Aplikacija je namenjena fizičkim licima koja imaju navršenih 15 godina ili više (u daljem tekstu: Korisnici).

2. Definicije

2.1. Mobilna aplikacija je aplikacija (IT rešenje) koje je napravljeno i funkcioniše na mobilnim uređajima, putem

kojih Korisnik može da se uloguje, kako bi koristio Aplikaciju i koristio usluge dostupne putem Aplikacije.

2.2. Mobilni uređaj je tehnički uređaj koji je sposoban za mobilni prenos podataka i mobilnu komunikaciju,

uključujući naročito, ali ne ograničavajući se na pametne telefone, tablete i slično.

3. Korišćenje aplikacije

3.1. Aplikacija je dostupna za preuzimanje na Apple Appstore i Google Play aplikaciji.

3.2. U slučaju preuzimanja aplikacije iz Apple Appstore ili Google Play prodavnice aplikacija, korisnik potvrđuje da

je pročitao opšte uslove korišćenja Apple Appstore ili Google Play prodavnice aplikacija, shvatio sadržaj istih i

takođe prihvata da su navedene odredbe obavezujuće za njega/nju, naročito uključujući odredbe kojima se

uređuje korišćenje Apple Appstore ili Google Play prodavnice aplikacija. Vlasnik aplikacije ne odgovara Korisniku za

rad Apple Appstore ili Google Play niti za bilo kakve posledice koje nastanu ili mogu nastati iz ili u vezi sa

korišćenjem Apple Appstore ili Google Play od strane korisnika.

3.3. Korisnik koristi Aplikaciju i internet isključivo na sopstvenu odgovornost. Vlasnik aplikacije ne daje garancije i

ne preuzima odgovornost za štetu koju Korisnik pretrpi prilikom korišćenja servisa i programskog paketa Aplikacije

i interneta. Internet je internacionalna računarska mreža koju Vlasnik aplikacije ne kontroliše ni posredno ni

neposredno, zbog toga ne garantuje dostupnost servisa nad kojima nema nikakvu kontrolu.

3.4. Korišćenjem sadržaja ove Aplikacije Korisnik prihvata (I) sve rizike koji mogu da nastanu iz njegovog korišćenja,

i (II) sadržaj ove Aplikacije koristi isključivo za ličnu upotrebu i na sopstvenu odgovornost.

3.5. Sve radnje učinjene korišćenjem Aplikacije smatraju se radnjama koje je napravio Korisnik.

3.6. Vlasnik aplikacije zadržava pravo da u bilo kom trenutku izvrši bilo kakve promene na Aplikaciji ili uslugama

koje se preko nje pružaju, uključujući bez ograničenja i to da prestane da pruža neke ili sve usluge, ili da uvede neke

druge usluge. Vlasnik aplikacije takođe zadržava pravo i da u bilo kom trenutku obustavi u potpunosti rad

Aplikacije. Korisnik neće imati prava na bilo kakvu naknadu u vezi sa ovim.

4. Ograničenje odgovornosti

4.1. Ovim se isključuje svaka odgovornost Vlasnika aplikacije (I) koja na bilo koji način može nastati korišćenjem

Aplikacije, ili je na bilo koji način u vezi s korišćenjem ove Aplikacije, (II) za bilo koje radnje Korisnika upotrebom ili

zloupotrebom sadržaja Aplikacije, te za (III) bilo kakvu štetu koja može biti prouzrokovana Korisniku ili bilo kojoj

trećoj strani u vezi s upotrebom ili zloupotrebom korišćenja sadržaja Aplikacije.

4.2 Korišćenje aplikacije "Ski Prep" podrazumeva određene rizike od povreda. Kao korisnik, prihvatanjem ove

politike razumete da trening može biti fizički zahtevan i da povrede mogu nastati usled nepravilnog izvođenja vežbi

ili prekomernog napora. Vlasnik aplikacije ne snosi odgovornost za eventualne povrede ili štetu koja može nastati

tokom korišćenja aplikacije "Ski Prep." Preporučujemo vam da konsultujete svog lekara pre nego što započnete

bilo koji program treninga kako biste se uverili da je odgovarajući za vaše trenutno zdravstveno stanje.

4.3.Korišćenjem aplikacije "Ski Prep," prihvatate ovo odricanje od odgovornosti i slažete se da koristite aplikaciju

na sopstveni rizik.

5. Politika privatnosti i zaštite podataka

5.1. Saglasno članu 23. Zakona o zaštiti podataka o ličnosti ("Sl. glasnik RS", br. 87/2018, u daljem tekstu: Zakon)

ispunjavajući dužnost rukovaoca u svojstvu pravnog lica prema Korisniku, kao licu od koga se prikupljaju podaci o

ličnosti koji se na Korisnika odnose, Vlasnik aplikacije pruža Korisniku u trenutku prikupljanja tih podataka sledeće

informacije:

3. Podaci o ličnosti

Vlasink aplikacije se obavezuje da će poštovati privatnost Korisnika Aplikacije.

Prihvatanjem Uslova korišćenja, Korisnik potvrđuje da je upoznat sa Opštim uslovima korišćenja “Ski Prep” mobilne

aplikacije i da je saglasan/saglasna sa njihovom primenom.

Korišćenjem Aplikacije Korisnik potvrđuje da je saglasan/saglasna sa prikupljanjem i obradom dostavljenjih

podataka o ličnosti, na način definisan u nastavku.

Lični podaci koje Ski Prep obrađuje sastoje se od podataka koje su Korisnici direktno dostavili.

Podaci koje su korisnici direktno dostavili popunjavanjem aplikacione forme, prilikom kreiranja naloga I

popunjavanja upitnika u okviru “Ski prep” aplikacije.

Za kreiranje naloga neophodno je dostaviti email adresu. Upitnik u okviru “Ski Prep” aplikacije prikuplja podatke o

psihofizčkom stanju korisnika, a na osnovu njegove/njene samoprocene. Svrha upitnika je kreiranje

personalizovanih programa za fizičku pripremu.

Svi podaci koje je Korisnik uneo u Aplikacionu formu nalaze se u profilu Korisnika Aplikacije.

4. Svrha i opravdani razlozi za obradu podataka o ličnosti

Vaše lične podatke koristimo isključivo za pružanje usluga naše aplikacije "Ski Prep" i komunikaciju sa vama u vezi

sa istom. Takođe, možemo koristiti vaše informacije za poboljšanje kvaliteta naše usluge, analizu trendova i

statistike.

Vlasnik aplikacije prvenstveno rukovodi i obrađuje podatke Korisnika koje su uneli u aplikacionu formu ali postoje

slučajevi kada je neophodno podeliti korisničke podatke sa trećim licima. To se može desiti u dva slučaja:

a) U slučaju neophodnog tehničkog održavanja od strane IT firme odgovorne za tehničko funkcionisanje aplikacije

b) Prilikom promene vlasništva nad Aplikacijom – ukoliko Aplikacija promeni vlasnika, korisnici Aplikacije moraju

biti obavešteni da su njihovi lični podaci preneti u vlasništvo novog vlasnika. Novi rukovalac podacima o ličnosti

korisnika mora izvršiti sve zakonom predviđene obaveze, a korisnik u slučaju promene vlasništva može da odluči da

li želi da nastavi sa korišćenjem usluga Aplikacije.

5. Prava korisnika

a) Korisnik ima pravo da u skladu sa članom 26. Zakona od rukovaoca zahteva pristup podacima, pravo na ispravku

i dopunu ili brisanje podataka o ličnosti Korisnika u skladu sa članom 29. i 30. Zakona, pravo na ograničenje obrade

u skladu sa članom 31. Zakona, prava na prenosivost podataka u skladu sa članom 36. Zakona, kao i pravo na

prigovor u skladu sa članom 37. Zakona. Korisnik putem opcije čet može zahtevati brisanje ličnih podataka i

brisanje naloga koje će biti izvršeno u roku od 7 dana nakon dostavljenog zahteva.

b) Korisnik ima pravo na opoziv pristanka u bilo koje vreme, s tim što opoziv pristanka ne utiče na dopuštenost

obrade na osnovu pristanka pre opoziva.

c) Korisnik ima pravo da u skladu sa članom 82. Zakona podnese pritužbu Povereniku za informacije od javnog

značaja i zaštitu podataka o ličnosti, ako smatra da je obrada podataka o ličnosti Korisnika izvršena suprotno

odredbama Zakona

d) Korisnik ima pravo na reklamaciju. Zahtev za reklamaciju može uputiti putem opcije chat u okviru aplikacije.

6. Zaštita informacija

Vlasnika aplikacije koristi tehničke i organizacione mere zaštite u cilju zaštite podataka o ličnosti. Vlasnika aplikacije

ulaže napore za konstantno održavanje i unapređenje sigurnosti. Redovno kontroliše sisteme zaštite informacija i

rad Aplikacije.

Ukoliko uprkos svim preduzetim merama dođe do narušavanja sigurnosti podataka, Vlasnik aplikacije će istog

trenutka obavestiti Korisnike i preduzeti sve mere kako bi se umanjio negativni efekat.

6. Autorska prava

6.1. Dokumenti, podaci i informacije objavljene na Aplikaciji ne smeju se reprodukovati, distribuirati ili na bilo koji

način koristiti u komercijalne svrhe (bez izričitog pristanka Vlasnika aplikacije) ili na bilo koji način koji može

uzrokovati štetu Vlasniku aplikacije ili bilo kojoj trećoj strani.

6.2. Dokumenti, podaci i informacije objavljeni na Aplikaciji mogu da se koriste samo za individualne potrebe

Korisnika uz poštovanje svih autorskih i vlasničkih prava kao i prava trećih lica.

6.3. Sve napomene o autorskim pravima, žigovima ili drugim autorskim pravima sadržanim u Aplikaciji ne smeju se

uklanjati, prekrivati ili zatamnjivati od strane Korisnika.

7. Dodatne odredbe o korišćenju Aplikacije

7.1. Nije dozvoljena zloupotreba „Ski Prep“ aplikacije i izvršavanje prevarnih radnji ili bilo kakvih radnji koje nisu u

skladu sa propisima Republike Srbije. U slučaju da dođe do izvršenja bilo koje takve radnje, Vlasnik aplikacije će

odmah onemogućiti dalji pristup Aplikaciji takvom Korisniku.

7.2. Korisnik je saglasan da neće koristiti ili pokušati da koristi tuđi korisnički nalog i/ili pristupati tuđim ličnim

podacima. Korisnik je saglasan da neće koristiti obrnuti inženjering, povratnu montažu, rastavljanje, dekodiranje ili

bilo koji drugi način za otkrivanje izvornog koda Aplikacije ili bilo koje povezane tehnologije.

7.3. Korisnik garantuje za tačnost podataka o ličnosti koje je dostavio Ski Prep-u.

7.4. Korišćenje Aplikacije je dozvoljeno licima koja imaju navršenih 15 i više godina.

8. Završne odredbe

8.1. Ažuriranje i modifikacije Aplikacije

Ovi Opšti uslovi primenjuju se za sve vreme u toku koga Korisnik koristi Aplikaciju. Vlasnik aplikacije zadržava pravo

da ove Opšte uslove ili bilo koji njihov deo u bilo kom trenutku izmeni.

8.2. Sudska nadležnost

Odnosi između Korisnika i Vlasnika aplikacije regulisani su pozitivnim propisima Republike Srbije. Za sve

međusobne sporove koje nije moguće rešiti dogovorom nadležan je sud u Beogradu.

Welcome to the "Ski Prep" application!

1. Introductory Provisions

Please carefully read the terms of use for the "Ski Prep" mobile application (hereinafter:

PR, the owner of the "Ski Prep" mobile application (hereinafter: Application Owner), and

you, the user of the application.

The user of the "Ski Prep" mobile application (hereinafter: Application) is a person who

meets the criteria set out in these Terms of Use and has read, understood, and fully

accepted the Terms of Use.

1.1. The Terms may be periodically updated or amended, after which they will be

published within the Application.

1.2. When the Terms are modified or revised, to continue using the Application, the user

will be required to consent to the updated Terms of Use and accept them.

1.3. If you do not agree with any of the conditions stated in the Terms of Use, please do

not use the "Ski Prep" Application.

1.4. The Application is the property of Aljoša Ljubićić PR, Vladimira Popovića 36, 11070

1.5. The Application is intended for individuals who are 15 years of age or older

(hereinafter: Users).

2. Definitions

2.1. A mobile application is an application (IT solution) created and operating on mobile

devices, through which Users can log in to use the Application and its services.

2.2. A mobile device is a technical device capable of mobile data transmission and

mobile communication, including, but not limited to, smartphones, tablets, and similar

devices.

3. Use of the Application

3.1. The Application is available for download on the Apple App Store and Google Play

Store.

3.2. When downloading the application from the Apple App Store or Google Play Store,

the user confirms that they have read the terms and conditions of use of the Apple App

Store or Google Play Store, understands their content, and also accepts that these terms

are binding on them, especially including the provisions governing the use of the Apple

App Store or Google Play Store applications. The Application Owner is not responsible

for the user's experience with the Apple App Store or Google Play, nor for any

consequences that may arise or have arisen from the user's use of the Apple App Store

or Google Play.

3.3. The user uses the Application and the internet solely at their own risk. The

Application Owner provides no warranties and assumes no responsibility for any

damage suffered by the user when using the services and software package of the

Application and the internet. The internet is an international computer network that the

Application Owner neither directly nor indirectly controls, and therefore, it does not

guarantee the availability of services over which it has no control.

3.4. By using the content of this Application, the User acknowledges (I) all risks that may

arise from its use, and (II) that they use the content of this Application solely for

personal use and at their own risk.

3.5. All actions taken using the Application are considered to be actions taken by the

User.

3.6. The Application Owner reserves the right to make any changes to the Application

or the services provided through it at any time, including but not limited to ceasing to

provide some or all services or introducing other services. The Application Owner also

reserves the right to discontinue the operation of the Application at any time. The user

will have no right to any compensation in this regard.

4. Limitation of Liability

4.1. This excludes any liability of the Application Owner (I) that may arise in any way

from the use of the Application or is in any way related to the use of this Application, (II)

for any actions of the User in the use or misuse of the content of the Application, and

for (III) any damage that may be caused to the User or any third party in connection with

the use or misuse of the content of the Application.

4.2. Using the "Ski Prep" application involves certain risks of injury. As a user, by

accepting this policy, you understand that training can be physically demanding and

that injuries can occur due to improper exercise or excessive effort. The Application

Owner is not responsible for any injuries or damage that may occur during the use of

the "Ski Prep" application. We recommend that you consult your doctor before starting

any training program to ensure it is suitable for your current health condition.

4.3. By using the "Ski Prep" application, you accept this disclaimer and agree to use the

application at your own risk.

5. Privacy Policy and Data Protection

5.1. In accordance with Article 23 of the Personal Data Protection Law ("Official Gazette

of the Republic of Serbia," No. 87/2018, hereinafter: the Law), and in fulfilling the duties

of the data controller as a legal entity towards the User, from whom personal data

related to the User is collected, the Application Owner provides the User, at the time of

collecting this data, with the following information:

3. The Application Owner undertakes to respect the privacy of Application Users.

By accepting the Terms of Use, the User confirms that they are familiar with the

General Terms of Use of the "Ski Prep" mobile application and that they agree

with their application. By using the Application, the User confirms that they

consent to the collection and processing of the provided personal data as

defined below.

Personal data processed by Ski Prep consists of data that Users have directly

provided. The data provided by users through filling out the application form

when creating an account and completing questionnaires within the "Ski Prep"

application.

To create an account, it is necessary to provide an email address. The

questionnaire within the "Ski Prep" application collects data about the user's

psychophysical condition based on their self-assessment. The purpose of the

questionnaire is to create personalized fitness programs.

All data entered by the User in the Application form are stored in the User's

Application profile.

4. Purpose and Juscaon for Personal Data Processing

We use your personal data exclusively to provide the services of our "Ski Prep"

application and to communicate with you regarding these services. Additionally,

we may use your information to improve the quality of our service and for trend

analysis and statistics.

The Application Owner primarily manages and processes User data entered into

the application form. However, there are cases where it is necessary to share user

data with third parties. This can happen in two cases:

a) In the case of necessary technical maintenance by the IT company responsible

for the technical functioning of the application.

b) In the event of a change in ownership of the Application. If the Application

changes ownership, Application users must be informed that their personal data

has been transferred to the new owner. The new data controller for user personal

data must fulfill all legal obligations. In the event of a change of ownership, the

user can decide whether to continue using the Application's services.

5. User Rights

a) In accordance with Article 26 of the Law, the User has the right to request

access to their data, the right to correct, supplement, or delete personal data in

accordance with Articles 29 and 30 of the Law, the right to restrict processing in

accordance with Article 31 of the Law, the right to data portability in accordance

with Article 36 of the Law, and the right to object in accordance with Article 37 of

the Law. The user may, through the chat option, request the deletion of personal

data and the removal of the account, which shall be executed within a period of 7

days following the submission of the request.

b) The User has the right to withdraw consent at any time, with the withdrawal of

consent not affecting the lawfulness of processing based on consent prior to

withdrawal.

c) The User has the right, in accordance with Article 82 of the Law, to file a

complaint with the Commissioner for Information of Public Importance and

Personal Data Protection if they believe that the processing of their personal data

has been contrary to the provisions of the Law.

d) The User has the right to file a complaint. A request for a complaint can be

made through the chat option within the application.

6. Information Protection

The Application Owner employs technical and organizational data protection

measures to safeguard personal data. The Application Owner makes efforts to

maintain and enhance security continuously. It regularly monitors information

protection systems and the operation of the Application.

If, despite all measures taken, a security breach occurs, the Application Owner will

immediately inform Users and take all necessary measures to minimize any

negative impact.

6. Copyright

6.1. Documents, data, and information published on the Application may not be

reproduced, distributed, or used in any way for commercial purposes (without the

explicit consent of the Application Owner) or in any way that could cause harm to the

Application Owner or any third party.

6.2. Documents, data, and information published on the Application may only be used

for the individual needs of the User while respecting all copyright and ownership rights,

as well as the rights of third parties.

6.3. All notices regarding copyright, trademarks, or other intellectual property rights

contained in the Application must not be removed, covered, or obscured by the User.

7. Additional Terms of Use of the Application

7.1. Abuse of the "Ski Prep" application and the commission of fraudulent activities or

any actions that are not in line with the regulations of the Republic of Serbia is not

allowed. In the event of the commission of any such action, the Application Owner will

immediately disable further access to the Application for such User.

7.2. The User agrees not to use or attempt to use another user's account and/or access

another user's personal data. The User agrees not to use reverse engineering,

disassembly, disassembly, decoding, or any other means to discover the source code of

the Application or any related technology.

7.3. The User guarantees the accuracy of the personal data provided to Ski Prep.

7.4. The use of the "Ski Prep" Application is permitted to individuals who are 15 years of

age or older.

8. Final Provisions

8.1. Updating and Modification of the Application These General Terms and Conditions

apply for the entire period during which the User uses the Application. The Application

Owner reserves the right to amend these General Terms and Conditions or any part

thereof at any time.

8.2. Jurisdiction The relationship between the User and the Application Owner is

governed by the positive regulations of the Republic of Serbia. For all disputes that

cannot be resolved by agreement, the competent court is in Belgrade.
